Terms of Service & Operator Agreement

1. Platform Scope & 0% Booking Commission SaaS Model

Alimbra CarRental (“Platform”) is a software-as-a-service (SaaS) discovery, storefront, and reservation management platform operated for local car rental businesses (“Operators” or “Garages”) and customers (“Renters”) in the Philippines.

• 0% Booking Commission: Alimbra CarRental does not charge sales commissions or percentage cuts on vehicle rental reservations.
• SaaS Subscription Model: Operators may use the Free Starter tier (₱0/month, up to 3 listed vehicles) or subscribe to the Pro Fleet plan (₱449/month, up to 15 vehicles, online reservation flow, schedule calendar, and custom destination rate tiers).
• Direct Rental Contract: Any vehicle rental agreement is entered into directly between the Renter and the independent Rental Garage Operator. Alimbra CarRental does not own, lease, insure, or dispatch vehicles.

2. Rental Operator Responsibilities

By registering a rental business on Alimbra CarRental, the Operator represents and warrants that they maintain full compliance with Philippine laws and regulations:

• Vehicle Roadworthiness & Registration: All listed vehicles must have valid Land Transportation Office (LTO) Official Receipt and Certificate of Registration (OR/CR), preventive maintenance, and appropriate insurance coverage.
• Pricing & Rate Tier Accuracy: Operators are solely responsible for keeping daily rates, destination rate tiers, hourly extension rates, driver fees, and delivery/collection charges accurate and transparent on their storefront.
• Business Permits & Tax Compliance: Operators are responsible for their own DTI/SEC registration, Mayor's / LGU Business Permits, and Bureau of Internal Revenue (BIR) official receipts and tax filings.

3. Renter Responsibilities & In-Person Verification

• Face-to-Face Document Verification: Renters must present their original physical Driver's License, required government-issued IDs, and supporting documents face-to-face at the rental office or upon vehicle handover.
• Direct Payment Settlement: Reservation down payments, security deposits, and rental balances are settled directly with the Operator according to the Operator's payment instructions.
• Authorized Destination & Return Schedule: Renters must adhere to the declared destination tier and scheduled return date/time agreed upon with the Operator.

4. Subscription Billing, Manual Renewals & No-Refund Rule

• Payment Processing: Pro Fleet subscription payments (₱449/month) are processed securely via PayMongo (supporting GCash, Maya, cards, and online banking).
• Manual Renewal Control: Subscriptions are billed per monthly term. Operators may switch back to the Free Starter tier at any time prior to the next billing period.
• No-Refund Policy on Activated Subscriptions: Once a Pro Fleet subscription billing period is activated on an Operator's account, the subscription fee is final and non-refundable. Please review our Refund & Cancellation Policy for full details.

5. Limitation of Liability

Alimbra CarRental provides the technology platform on an “as-is” basis and shall not be liable for vehicle accidents, mechanical breakdowns, traffic violations, property damage, or payment disputes arising between Renters and independent Operators.
